Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Fallen Fur (the “Game”), operated by Görkem Koşar (“I,” “me,” “my,” or the “Owner”).

By downloading, installing, accessing, purchasing through, or using the Game, you agree to these Terms. The Privacy Policy explains how personal data is processed and is provided separately for information. If you do not agree to these Terms, do not download, access, purchase through, or use the Game. 

If you use the Game on behalf of another person, you confirm that you have authority to accept these Terms on that person’s behalf.

1. General Audience and Eligibility

The Game is intended for a general audience and is not directed primarily to children.

The Game may request your birth year on first launch to apply age-based advertising, privacy, consent, and compliance settings.

If you are under the age required to enter into a binding agreement in your jurisdiction, you may use the Game only with the permission and supervision of a parent or legal guardian.

Certain features, including pet-submission opportunities, may be restricted to adults aged 18 or over.

You must provide truthful age information. You may not bypass, manipulate, falsify, or interfere with the Game’s age gate, privacy settings, consent systems, or child-protection measures.

2. License to Use the Game

Subject to your compliance with these Terms, I grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, access, and use the Game solely for lawful, personal, non-commercial entertainment purposes.

This license does not transfer ownership of the Game or any content, asset, software, data, or intellectual property contained in or made available through the Game.

All rights not expressly granted are reserved.

3. Accounts and Guest Access

You may be able to use the Game as a guest or create an account using email and password, Google, Apple, or another login method made available in the Game.

Users under 13 must not create a registered account, use Google or Apple sign-in, or provide an email address unless a legally valid parental-consent process is available. Where no such process is available, users under 13 may use only guest access. 

Guest users may be assigned an anonymous account identifier and may have local or cloud-linked progress.

You are responsible for:

• providing accurate and current account information;

• maintaining the confidentiality of your login credentials;

• protecting access to your device and account;

• all activity occurring through your account;

• notifying me promptly if you suspect unauthorized access.

You must not:

• impersonate another person or entity;

• create an account using false or misleading information;

• create accounts for fraudulent, abusive, automated, or unlawful purposes;

• sell, transfer, share, or commercially trade accounts;

• bypass account restrictions or suspensions;

• use another person’s account without permission.

I may require account verification or additional information where reasonably necessary for security, fraud prevention, abuse prevention, legal compliance, or protection of the Game and its users.

4. Usernames and Public Profile Information

If usernames, profiles, leaderboards, multiplayer features, or other public-facing features are available now or in the future, usernames and profile information must not be:

• unlawful, fraudulent, deceptive, or misleading;

• offensive, abusive, threatening, hateful, or sexually explicit;

• defamatory or harassing;

• infringing of copyright, trademark, privacy, publicity, or other rights;

• designed to impersonate another person, brand, organization, or authority;

• used to advertise, solicit, spam, or direct users to unsafe content.

I may remove, hide, reset, restrict, or change a username or profile, with or without notice, where I consider this reasonably necessary.

No user has a permanent entitlement to a particular username, profile name, ranking, public display, or leaderboard position.

5. Purchases, Subscriptions, and Virtual Items

The Game may offer subscriptions, one-time purchases, virtual items, virtual currency, and digital benefits.

These may include:

• removal of certain advertisements;

• recurring or periodic in-game gold;

• lives;

• hints;

• cosmetic or gameplay benefits;

• access to features or submission opportunities.

Payments may be processed by Apple, Google, RevenueCat, or other platform, billing, transaction-validation, or entitlement providers.

I do not directly receive or process your complete payment-card information.

5.1 Subscription renewals

Subscriptions may automatically renew unless cancelled through the applicable Apple or Google account settings before the renewal date.

Deleting the Game or deleting a Game account may not automatically cancel an active subscription. You are responsible for managing cancellation through the platform from which the subscription was purchased.

5.2 Refunds

Refunds, cancellations, billing disputes, and renewal rules are generally handled by the applicable app store or payment provider.

Except where required by applicable law or platform rules:

• purchases are final;

• unused virtual items are not refundable;

• virtual items cannot be exchanged for money;

• virtual items have no cash value;

• virtual items are licensed, not sold;

• I am not required to refund purchases because of dissatisfaction, discontinued play, loss of interest, account termination resulting from a violation, or changes to Game content.

Nothing in these Terms limits any mandatory consumer right that cannot legally be waived.

5.3 Changes to purchases and benefits

To the extent permitted by law and platform rules, I may change:

• prices;

• subscription periods;

• renewal terms;

• included benefits;

• reward quantities;

• virtual-item availability;

• feature availability.

Material changes affecting active subscriptions will be handled in accordance with applicable platform rules and mandatory law.

6. Virtual Items and Game Progress

Virtual items, gold, lives, hints, rankings, rewards, progress, and other digital records are provided as limited Game features.

They are not money, property, stored value, securities, or financial instruments.

I may, where reasonably necessary:

• correct erroneous balances;

• reverse fraudulent rewards;

• remove duplicated items;

• reset corrupted progress;

• rebalance rewards or costs;

• modify availability;

• discontinue virtual items or systems.

I do not guarantee that virtual items, progress, rankings, rewards, or account data will remain available permanently.

7. Acceptable Use Restrictions

You must not, and must not help another person to:

• copy, sell, lease, rent, sublicense, distribute, publish, or commercially exploit the Game;

• reverse engineer, decompile, disassemble, decode, modify, translate, adapt, or attempt to obtain source code;

• create unauthorized derivative versions of the Game;

• extract, rip, scrape, harvest, download, copy, export, or reuse Game assets except where expressly permitted;

• extract images, sprites, textures, stickers, illustrations, audio, animations, fonts, code, databases, level files, downloaded packages, metadata, cache files, configuration files, or server data;

• bypass, disable, obstruct, or interfere with security systems, access controls, advertising, subscriptions, payments, age gates, consent systems, anti-cheat measures, or technical protections;

• use bots, macros, automation, scripts, cheats, exploits, mods, memory editors, packet manipulation, emulators for abuse, unauthorized tools, or modified clients;

• manipulate rewards, purchases, advertisements, timers, leaderboards, multiplayer results, referrals, account systems, or consent choices;

• create fraudulent, duplicate, or automated accounts;

• abuse refunds, chargebacks, promotions, subscriptions, support systems, or reporting tools;

• introduce malware, harmful code, denial-of-service activity, or unauthorized software;

• probe, scan, test, attack, or interfere with the Game’s systems or third-party systems;

• collect information about other users without authorization;

• use the Game to violate law or the rights of another person;

• encourage or assist any prohibited activity.

8. Intellectual Property

The Game and all associated content are owned by me, licensed to me, or otherwise used under applicable rights and permissions.

Protected content includes, without limitation:

• the Fallen Fur name and presentation;

• Game design, layout, interface, mechanics, and audiovisual presentation;

• cat and dog illustrations;

• AI-assisted or AI-generated artwork selected, arranged, edited, modified, compiled, or incorporated by me;

• edited pet videos, video clips, still frames extracted from videos, captions, subtitles, compilations, promotional edits, and other audiovisual content created, selected, arranged, edited, or produced by me; 

• stickers and export images;

• level designs and level files;

• downloadable content;

• text, stories, captions, and dialogue created by me;

• music, sound effects, icons, logos, and animations;

• software, code, databases, data organization, and technical systems;

• promotional materials, trailers, screenshots, and social-media content created by me.

Nothing in the Game grants you any right to use my trademarks, trade dress, artwork, branding, or other intellectual property except for the limited personal-use rights expressly provided in these Terms.

9. Limited Permission for Saved Images

The Game may permit users to save certain images, stickers, or share cards to a device gallery.

Where the Game expressly provides this function, you may use the saved material only for personal, non-commercial use and ordinary personal sharing.

You may not:

• sell, license, rent, or commercially distribute it;

• upload it as an asset pack, stock image, template, or downloadable sticker collection;

• create merchandise using it;

• use it in advertising or commercial branding;

• claim that you created or own it;

• remove copyright, attribution, watermark, or ownership notices;

• mint or tokenize it;

• use it in an artificial-intelligence dataset;

• use it to train, evaluate, fine-tune, or improve an artificial-intelligence system;

• reproduce or redistribute substantial collections of Game artwork.

This permission may be withdrawn if you violate these Terms.

10. Artificial Intelligence and Dataset Restrictions

Unless I give prior written permission, you may not use the Game or its content to:

• train, fine-tune, test, benchmark, validate, or improve an artificial-intelligence or machine-learning system;

• construct, supplement, or distribute a dataset;

• produce embeddings, model weights, style libraries, or asset libraries;

• conduct automated scraping, extraction, classification, or analysis for reuse;

• generate imitations or derivative asset collections;

• reproduce the Game’s distinctive illustrations, visual style, or compiled content commercially.

11. Community Pet Levels and External Pet Submissions

The Game may feature daily or special levels inspired by pets whose owners voluntarily send photographs, videos, stories, names, usernames, links, or other materials to me outside the Game.

Submitted photographs, resulting illustrations, pet names, and edited stories may appear inside the Game. Submitted videos are intended primarily for official Fallen Fur social-media and promotional use and are not necessarily intended to appear inside the Game.

Submissions may be received through:

• Instagram;

• email;

• Google Forms or other website forms;

• Google Drive or other cloud-storage services;

• social-media messages;

• other communication channels I choose to accept.

Submitting content does not guarantee that it will be reviewed, selected, illustrated, published, credited, linked, displayed, or retained.

Pet submissions are subject to these Terms, the Privacy Policy, the separate Pet Submission, AI Illustration and Publication Agreement, the separate Pet Submission Privacy Notice, and the submitter’s consent, publication, attribution, ownership, and permission choices recorded through the applicable submission form. 

If there is a conflict relating specifically to a pet submission, the separate Pet Submission Agreement will control.

12. Adult-Only Pet Submissions

Only individuals aged 18 or over may submit pet materials or enter into a Pet Submission Agreement.

I do not accept submissions made directly by minors.

An adult must not submit materials on behalf of a minor unless I have expressly agreed in writing to a separate process and any required parent or legal guardian permissions have been properly provided.

I may request reasonable proof of age, identity, ownership, or authority before considering a submission.

13. Pet Submission Requirements

A submitter must provide only materials that the submitter owns or is fully authorized to provide and license.

By submitting material, the submitter represents and warrants that:

• the submitter is at least 18 years old;

• the submitter owns the pet or has authority from the pet’s owner;

• the submitter personally took every submitted photograph and recorded every submitted video, or has obtained all necessary written permissions from every photographer, videographer, copyright owner, and other relevant rights holder; 

• every submitted video is original or fully authorized and does not contain unauthorized music, audio, television, radio, films, private conversations, or other third-party audiovisual material; 

• the submitter has authority to provide the pet’s name, story, social-media account, username, channel, and link;

• the material does not violate copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights;

• the material is truthful to the best of the submitter’s knowledge;

• the material is not unlawful, defamatory, threatening, abusive, hateful, obscene, fraudulent, deceptive, or harmful;

• the material does not contain unauthorized advertising, spam, scams, or unsafe links.

Submissions must not contain:

• identifiable people;

• images, videos, voices, or information relating to children;

• faces, bodies, voices, private conversations, or personal images of third parties;

• unauthorized music, sound recordings, television, radio, films, or other copyrighted audiovisual content;

• addresses or precise location information;

• telephone numbers;

• private email addresses intended to remain private;

• vehicle registration plates;

• identification documents;

• financial or payment information;

• medical or similarly sensitive personal information;

• confidential documents;

• photographs, videos, audio, text, or other material the submitter is not authorized to use;

• illegal, graphic, dangerous, abusive, or harmful material.

I may reject a submission whenever I believe these requirements have not been met.

14. License Granted for Pet Submissions

The submitter retains any ownership the submitter may have in the original submitted photographs, videos, audio, and text. 

However, by completing the separate Pet Submission Agreement and sending the materials, the submitter grants me, to the broadest extent permitted by law, a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to:

• receive, access, copy, store, host, download, transfer, back up, and review the materials;

• send or make the materials available to service providers and one or more artificial-intelligence, image-processing, video-processing, audio-processing, editing, hosting, communication, storage, translation, or production tools;

• crop, resize, rotate, retouch, edit, redact, recolor, mute, shorten, trim, loop, stabilize, reframe, combine, split, subtitle, caption, translate, change speed, extract still frames from, transform, summarize, rewrite, expand, rearrange, adapt, or otherwise modify the materials;

• create AI-assisted, AI-generated, stylized, humorous, fictional, exaggerated, or derivative illustrations and audiovisual content inspired by the pet;

• reproduce, publish, publicly display, distribute, communicate, stream, transmit, and make available all or part of the submission;

• include photographs, illustrations, the pet’s name, and edited stories inside the Game where appropriate;

• use photographs, submitted videos, edited video clips, still frames, illustrations, stories, names, credits, usernames, and authorized links on websites, social-media accounts, video platforms, app-store pages, advertisements, trailers, promotional posts, press materials, and marketing campaigns;

• use the pet’s name, story, attribution, social-media username, channel name, page name, and link where separately authorized;

• retain and archive materials and records where reasonably required for operation, publication, evidence, security, complaints, disputes, enforcement, or legal compliance.

The intellectual-property license is intended to continue for as long as reasonably necessary for these purposes and, to the extent permitted by law, for previously created and published materials. It does not limit privacy or other rights that cannot legally be waived.

15. Artificial-Intelligence and External Processing of Pet Materials 

Pet materials may be processed by one or more artificial-intelligence, image-generation, image-editing, video-editing, audio-editing, text-editing, translation, hosting, storage, or other technology providers. 

I am not required to promise, select, or use a particular artificial-intelligence provider, model, software, workflow, or combination of services. Information concerning provider categories or specific providers will be provided where required by applicable law or as described in the Pet Submission Privacy Notice. 

The submitter acknowledges that:

• material may be technically processed outside the submitter’s country;

• generated results may be inaccurate or unpredictable;

• an illustration may not exactly resemble the pet;

• colors, anatomy, pose, setting, clothing, accessories, expression, background, size, and other features may be changed;

• multiple images may be combined;

• fictional or exaggerated features may be introduced;

• some submitted details may be ignored or omitted;

• a resulting image may differ substantially from the submitter’s expectations;

• submitted videos may be muted, trimmed, cropped, reframed, stabilized, looped, captioned, combined, split, accelerated, slowed down, or otherwise edited;

• still images may be extracted from submitted videos;

• some video or audio content may be removed entirely;

• the final edited video may differ substantially from the original submitted video;

• submitted videos may be published together with illustrations, captions, music or audio lawfully selected by me, logos, promotional text, or other Fallen Fur content;

• a submitted video may be used even if the related daily level is no longer available inside the Game.

No submitter has a right to require a particular provider, process, artificial-intelligence model, artistic style, video-editing style, duration, format, output, similarity level, soundtrack, caption, revision, or result. 

16. Full Editorial Control

I retain complete editorial and creative discretion over pet submissions and resulting content, subject to mandatory law.

I may, without obtaining further approval:

• accept or reject a submission;

• use all, part, or none of a submission;

• select which photographs appear;

• omit original photographs entirely;

• rewrite, shorten, expand, translate, correct, censor, or rearrange a story;

• remove names, usernames, links, claims, or identifying details;

• choose whether and how to credit a submitter or pet owner;

• decline to include an external link;

• change the order, layout, wording, visual presentation, or duration;

• create an illustration that differs from the original photograph;

• combine or separate submitted elements;

• delay publication;

• cancel planned publication;

• publish without providing a preview;

• decline revisions;

• remove or replace content after publication;

• select which submitted videos or portions of videos are used;

• omit submitted videos entirely;

• mute or remove original audio;

• shorten, crop, loop, stabilize, resize, reframe, caption, subtitle, combine, split, change the speed of, or otherwise edit a video;

• extract and publish still frames from videos;

• combine videos with illustrations, photographs, text, logos, music, audio, effects, or other promotional content;

• publish a video independently from the related daily level;

• keep social-media content available after the related daily level has ended;

• remove, archive, repost, republish, replace, or edit social-media content.

The submitter has no contractual right to approve, reject, edit, supervise, or control the final illustration, photograph selection, video edit, audio edit, story, level, caption, credit, link, publication channel, publication date, display duration, promotional presentation, or other resulting content. 

17. No Guarantee of Selection, Publication, or Availability

Submission does not create an obligation for me to:

• respond;

• review the material within a particular period;

• select the submission;

• create an illustration;

• create or publish a level;

• publish original photographs;

• publish the submitted story;

• include an owner name, username, or link;

• provide a reason for rejection;

• provide revisions;

• publish by a particular date;

• keep content available for a minimum period;

• preserve or archive a daily level; 

• edit or publish a submitted video;

• use the entire submitted video;

• preserve the original video audio;

• publish content on any particular social-media platform;

• keep a social-media post available for a minimum period;

• obtain a particular number of views, likes, comments, followers, shares, or other engagement.

A pet level described as a “daily level” may be available for one day, for a shorter period, for a longer period, more than once, or not at all.

I may remove, replace, suspend, archive, repeat, or discontinue a pet level or related content at any time where I consider this necessary or appropriate.

A submitted video or related social-media post may be published before, during, or after the related daily level. It may remain available after the daily level has ended, or it may be edited, removed, archived, reposted, replaced, or discontinued at any time. 

18. Free and Paid Pet Submission Opportunities

Pet submissions may be offered free of charge, for a fee, through a promotion, by invitation, or under other conditions disclosed at the time.

A payment for a pet-submission opportunity does not purchase:

• guaranteed publication;

• guaranteed selection;

• ownership of an illustration;

• a commissioned artwork;

• a guaranteed level;

• guaranteed approval;

• guaranteed revisions;

• guaranteed exposure;

• guaranteed traffic, followers, publicity, or financial benefit;

• a particular publication date or display period; 

• guaranteed use or publication of a submitted video;

• guaranteed video length, editing style, soundtrack, caption, platform, or format;

• guaranteed social-media publication;

• guaranteed social-media engagement;

• a minimum period during which a social-media post will remain available.

Unless expressly stated otherwise at the point of purchase, any fee is paid for the submission opportunity, administrative handling, eligibility, review, moderation, processing, or consideration of the materials—not for a guaranteed publication result.

Where a paid pet-submission opportunity is offered inside the Game, payment will be processed through Apple’s In-App Purchase system or Google Play’s billing system where required by the applicable platform rules. RevenueCat or another authorized entitlement provider may be used to validate and manage the purchase. Alternative payment methods will be offered only where permitted by applicable law and platform rules. 

Refunds are subject to applicable law, the relevant app-store rules, and the terms shown at purchase. Except where required by law or platform rules, rejection, non-selection, editorial changes, video editing, removal of audio, non-publication, delayed publication, removal of a Game level, removal of a social-media post, or dissatisfaction with an illustration or edited video does not automatically create a right to a refund. 

The non-guaranteed nature of the opportunity must also be disclosed clearly on the relevant purchase or submission screen.

19. Ownership of Resulting Illustrations, Edited Videos, and Levels 

The submitter does not acquire ownership of the Game, daily level, resulting illustration, edited video, video clip, still frame, caption, subtitle, soundtrack selection, promotional content, level layout, edited text, design, presentation, code, interface, or other material created, selected, arranged, or edited by me. 

To the extent permitted by law, all rights available to me in the following are owned or controlled by me:

• AI-assisted or AI-generated illustrations;

• my prompts, selections, arrangements, edits, modifications, and creative decisions;

• level designs and layouts;

• rewritten or edited stories;

• promotional designs;

• compiled Game content;

• video edits, compilations, clips, still-frame selections, captions, subtitles, layouts, and promotional arrangements created by me;

• my selection, timing, sequencing, cropping, muting, combination, formatting, and presentation of submitted audiovisual materials;

• social-media posts, trailers, advertisements, and promotional audiovisual content created by me.

Submission, selection, credit, or publication does not create a partnership, employment relationship, agency relationship, joint venture, royalty entitlement, revenue share, or co-ownership arrangement.

No payment, royalty, fee, commission, revenue share, or other compensation is owed to the submitter unless I expressly agree otherwise in a separate written document.

20. Attribution, Names, Usernames, and External Links

I may, but am not required to, display:

• the pet’s name;

• the pet owner’s or submitter’s name, where separately authorized;

• a photographer, videographer, or other rights-holder credit, where separately authorized;

• an Instagram, TikTok, YouTube, or other username, where separately authorized;

• a channel or page name, where separately authorized;

• an external website or social-media link, where separately authorized.

I may choose whether attribution appears and may change, shorten, format, position, delay, remove, refuse, or disable any name, photographer credit, videographer credit, username, channel, page, or link. 

Displaying a link, account, username, or story does not mean that I endorse, sponsor, verify, guarantee, or accept responsibility for that external person, page, account, product, claim, or content.

I am not responsible for:

• an external page becoming unavailable;

• changes made by the external page owner;

• unsafe or unlawful content added later;

• third-party interactions occurring outside the Game;

• loss of traffic, followers, sales, reputation, or opportunity.

21. Moderation and Removal of Pet Content

All pet submissions are subject to manual or automated review.

I may reject, edit, hide, suspend, or remove content that I believe:

• violates these Terms;

• creates legal, privacy, intellectual-property, security, or platform risk;

• includes misleading or unverifiable claims;

• is offensive, unsuitable, unsafe, or inconsistent with the Game;

• contains personal information;

• contains third-party material without adequate permission;

• may expose me or another person to a complaint or dispute;

• is no longer appropriate or technically supportable; 

• contains unauthorized music, voices, video, television, radio, films, or other audiovisual material;

• includes a person, child, private conversation, location, registration plate, document, or other prohibited information;

• creates a claim from a photographer, videographer, musician, performer, pet owner, copyright owner, or platform.

Users may report pet content or other Game content by contacting fallenfurgame@gmail.com.

I may investigate reports and take any action I consider appropriate, but I do not guarantee a particular outcome, response time, or explanation.

22. Withdrawal, Removal Requests, and Existing Copies

Any privacy, withdrawal, objection, or removal request will be handled in accordance with applicable law, the Privacy Policy, the separate Pet Submission Privacy Notice, and the separate Pet Submission Agreement. 

To the maximum extent permitted by law:

• withdrawal does not make earlier lawful processing or publication unlawful;

• I may retain limited records needed to prove permission, respond to complaints, defend legal claims, prevent fraud, or satisfy legal obligations;

• removal from the Game or my controlled accounts does not guarantee removal from screenshots, recordings, downloads, caches, search engines, archives, backups, or reposts controlled by third parties;

• I am not responsible for copies made or distributed by other users or third parties without my authorization.

Removal of a submitted video or social-media post from an account controlled by me does not guarantee removal of copies, screen recordings, downloads, platform backups, caches, archives, shares, embeds, or reposts controlled by social-media platforms or third parties. 

23. Future Online Features

The Game may later include:

• leaderboards;

• public profiles;

• multiplayer;

• events;

• community features;

• cloud functions;

• reporting systems;

• additional submission features.

I may introduce additional rules, moderation systems, technical requirements, eligibility rules, or separate agreements for these features.

I may modify, limit, suspend, or discontinue online features at any time.

24. Updates and Changes to the Game

I may update, patch, rebalance, replace, suspend, or remove any part of the Game, including:

• levels;

• rewards;

• subscriptions;

• purchases;

• advertisements;

• artwork;

• login options;

• privacy and consent flows;

• supported devices;

• server features;

• online functionality;

• pet levels;

• third-party integrations.

I do not guarantee that any particular feature, provider, level, item, reward, price, or service will remain available.

25. Third-Party Services

The Game may depend on third-party services for:

• authentication;

• cloud storage and databases;

• analytics;

• advertising and mediation;

• privacy and consent management;

• subscriptions and purchases;

• notifications;

• hosting;

• artificial-intelligence processing;

• image editing;

• video editing;

• audio editing;

• video hosting and distribution;

• social-media publication;

• media storage and backup; 

• communication;

• app distribution.

Third-party services may be subject to separate terms and privacy policies.

I do not control and am not responsible for third-party:

• outages;

• errors;

• data loss;

• account actions;

• payment decisions;

• policy changes;

• service discontinuation;

• security incidents;

• content;

• processing practices.

26. Suspension and Termination

I may suspend, restrict, disable, or terminate access to the Game or an account, with or without prior notice, where I reasonably believe that:

• these Terms have been violated;

• an account is involved in cheating, fraud, abuse, harassment, chargeback abuse, or unlawful activity;

• action is needed to protect the Game, users, third parties, or me;

• a platform, service provider, or authority requires action;

• technical, security, legal, or operational reasons make action necessary.

Upon termination, the license granted under these Terms ends immediately.

Termination may result in loss of progress, virtual items, account features, or access to online services, subject to mandatory law.

27. Account Deletion

You may initiate account deletion through the Game where available or use the deletion process described at:

https://www.fallenfur.com/account-deletion

Deleting an account may permanently delete or de-identify:

• profile information;

• username;

• progress;

• cloud-save records;

• account-linked rewards;

• other account data.

Some information may be retained where reasonably required for:

• legal obligations;

• accounting or tax requirements;

• payment and subscription records;

• security;

• fraud prevention;

• dispute resolution;

• chargebacks;

• enforcement of these Terms;

• platform compliance.

Deleting a Game account may not delete information independently controlled by Apple, Google, RevenueCat, advertising providers, login providers, or other third parties.

Deleting a Game account does not automatically cancel an app-store subscription.

Deleting a Fallen Fur Game account does not automatically delete materials submitted separately through the pet-submission program. Pet-submission photographs, videos, stories, consent records, ownership evidence, permission records, and publication-related requests are handled separately under the Privacy Policy, Pet Submission Privacy Notice, and Pet Submission Agreement. 

28. Entertainment Only and Responsible Use

The Game is provided solely for entertainment.

You are responsible for deciding how much time and money you spend on the Game and for using device-level parental controls, purchase controls, screen-time settings, notification controls, and other available safeguards where appropriate.

To the maximum extent permitted by law, I do not guarantee that the Game will:

• satisfy expectations;

• improve mood;

• provide uninterrupted enjoyment;

• prevent boredom, frustration, disappointment, dissatisfaction, or emotional distress;

• produce any social, financial, competitive, or personal benefit.

29. Excessive or Compulsive Use

To the maximum extent permitted by law, I am not responsible for:

• excessive or compulsive use;

• difficulty limiting play time;

• voluntary spending decisions;

• regret concerning purchases;

• missed opportunities;

• loss of sleep, productivity, or attention;

• interpersonal disputes related to use;

• frustration caused by gameplay, advertisements, purchases, rewards, losses, or service interruption.

This section does not exclude liability that cannot legally be excluded and does not reduce any mandatory consumer protection right.

30. No Warranty

To the maximum extent permitted by law, the Game is provided “as is,” “as available,” and “with all faults.”

I disclaim warranties of every kind, whether express, implied, or statutory, including warranties of:

• merchantability;

• fitness for a particular purpose;

• non-infringement;

• uninterrupted operation;

• availability;

• accuracy;

• security;

• compatibility;

• error-free performance.

I do not guarantee that:

• servers or services will always be available;

• the Game will operate on every device;

• data or progress will never be lost;

• defects will be corrected;

• third-party services will continue;

• content will be accurate, complete, or suitable;

• an account will remain accessible.

31. Limitation of Liability

To the maximum extent permitted by applicable law, I will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

This includes losses arising from:

• inability to access or use the Game;

• loss of data or progress;

• loss of virtual items;

• loss of profits, income, opportunity, reputation, goodwill, followers, traffic, or publicity;

• device problems;

• service interruption;

• unauthorized access;

• reliance on Game content;

• third-party services;

• pet submission selection or rejection;

• editing or non-publication;

• removal of content;

• user spending decisions;

• excessive or compulsive use;

• emotional disappointment, frustration, or dissatisfaction; 

• video editing or transformation;

• removal or replacement of original video audio;

• inaccurate, unexpected, or unsatisfactory video results;

• failure to publish a video;

• removal or editing of a social-media post;

• third-party copying, downloading, recording, embedding, sharing, or reposting;

• copyright or platform action caused by submitted material;

• loss of views, likes, comments, followers, shares, reach, or engagement.

To the maximum extent permitted by law, my total aggregate liability for all claims arising from or related to the Game will not exceed the total amount you paid in connection with the Game during the twelve months immediately before the event giving rise to the claim.

If applicable law requires a different minimum remedy or does not permit a particular limitation, that mandatory law will apply only to the extent required.

32. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Görkem Koşar from claims, demands, proceedings, liabilities, damages, losses, judgments, settlements, fines, penalties, and reasonable expenses arising from or related to:

• your misuse of the Game;

• your violation of these Terms;

• your unlawful or abusive conduct;

• your submitted materials;

• your lack of authority to submit materials;

• infringement of copyright, trademark, privacy, publicity, confidentiality, or other rights;

• inaccurate statements or warranties made by you;

• external links or accounts you ask me to publish;

• claims made by a pet owner, photographer, videographer, musician, performer, copyright owner, account owner, platform, or other third party concerning your photographs, videos, audio, story, links, permissions, or submission;  

• unauthorized music, human voices, video footage, audiovisual content, private information, or other third-party material included in the submission; 

This obligation does not apply to the extent prohibited by applicable law.

33. Privacy

Use of the Game is governed by the Fallen Fur Privacy Policy.

Pet submissions are additionally governed by the separate Pet Submission, AI Illustration and Publication Agreement and the separate Pet Submission Privacy Notice.

Pet-submission consent choices, publication permissions, ownership declarations, and electronic acceptance may also be recorded through the applicable submission form.

34. Electronic Communications

You agree that notices, disclosures, requests, permissions, agreements, and other communications may be provided electronically, including through:

• the Game;

• email;

• website pages;

• Instagram or other social-media messages;

• electronic forms;

• app-store communications.

Electronic acceptance, checkbox acceptance, typed-name acceptance, email confirmation, or another affirmative electronic action may be used as evidence of agreement, subject to applicable law.

35. Governing Law

These Terms are governed by the laws of Türkiye, without regard to conflict-of-law principles.

Mandatory consumer, privacy, or other protections applicable in your country of residence remain unaffected where they cannot legally be waived.

36. Changes to These Terms

I may update these Terms from time to time.

If changes are material, I may provide notice through the Game, website, app-store listing, email, or another reasonable method.

The updated Terms will apply from the stated effective date.

Where applicable law requires renewed consent or acceptance, I will request it.

37. Severability

If any part of these Terms is found unlawful, invalid, or unenforceable, that part will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

38. No Waiver

Failure or delay in enforcing any provision does not waive the right to enforce it later.

A waiver is effective only if made clearly and in writing.

39. Assignment

You may not assign or transfer your rights or obligations under these Terms without my prior written permission.

I may assign or transfer my rights and obligations in connection with a sale, transfer, restructuring, outsourcing, succession, or change in operation of the Game, subject to applicable law.

40. Entire Agreement and Order of Priority

These Terms, applicable purchase disclosures, and any feature-specific agreement form the contractual terms relating to your use of the Game.

The Privacy Policy and Pet Submission Privacy Notice explain personal-data processing and are provided separately from the contractual terms.

For pet submissions, the separate Pet Submission, AI Illustration and Publication Agreement and the submitter’s recorded consent, publication, attribution, ownership, and permission choices apply in addition to these Terms.

Where documents or recorded choices conflict:

• mandatory law controls;

• a specific purchase disclosure controls for that purchase;

• the submitter’s recorded consent and permission choices control the scope of optional attribution, personal-name publication, usernames, credits, and links;

• the Pet Submission Agreement controls other matters specifically relating to the relevant pet submission;

• these Terms control general use of the Game.

41. Survival

Provisions relating to intellectual property, licenses, payment obligations, restrictions, ownership, pet submissions, liability, indemnification, dispute handling, and any provision that by its nature should continue will survive termination.
